1. About These Terms
These Terms & Conditions apply to the use of the Nomad of the Blue website and to bookings made for wildlife tours, boat trips, photographic expeditions and related experiences offered by Nomad of the Blue ("we", "us" or "our").
By using our website, submitting a booking application or booking one of our services, you agree to the terms applicable to that activity.
Specific trip descriptions, booking confirmations, payment schedules and additional participation requirements form part of the agreement for your booking. Where specific trip terms differ from these general terms, the specific terms will apply to that trip to the extent permitted by applicable law.

2. Our Services
Nomad of the Blue organises wildlife day tours and multi-day expeditions focused on observing, experiencing and photographing marine wildlife in natural environments.
Our services may include boat trips, wildlife observation, snorkelling, swimming or entering the water where permitted, photographic guidance, accommodation, meals, ground transportation and other services described in the relevant trip information.
The exact inclusions, exclusions, duration, location, itinerary, group size and price are specified on the relevant trip page or in the booking confirmation.
Unless expressly stated otherwise, our services do not constitute professional diving instruction, freediving certification, medical supervision or a guarantee of wildlife encounters.
3. Applications and Booking Confirmation
Some expeditions require an application before booking. Submitting an application does not guarantee acceptance or reserve a place.
We review applications to assess suitability for the particular expedition and group. If an application is accepted, we will provide the next steps and a booking link where applicable.
A place is confirmed only when we have accepted the booking and received the required deposit or payment, as specified in the relevant booking instructions.
Any temporary hold on a place, including a 12-hour hold where offered, expires at the stated time unless the required payment is completed. We may then offer the place to another applicant.
Participants must provide accurate contact details and any information reasonably required to organise the trip safely.
We reserve the right to decline an application or booking where there are reasonable concerns about safety, suitability, compliance with applicable requirements or the ability to deliver the service as described. Any payments already made will be handled in accordance with the applicable cancellation terms and law.
4. Prices and Payments
Prices, currencies, payment deadlines, deposit amounts and included services are stated on the relevant trip page or booking confirmation.
A deposit secures a place according to the booking conditions for that particular trip. Deposits are not automatically refundable; their treatment in the event of cancellation is explained in Section 8.
The remaining balance must be paid by the deadline communicated at booking. If payment is not received, we may send a reminder and, subject to applicable law and the specific booking terms, cancel the reservation and release the place.
Unless expressly included, participants are responsible for their own flights, travel documents, visas, personal travel insurance, additional accommodation, personal expenses, tips and other excluded costs.
Any additional fees, taxes or payment-processing charges will be disclosed before payment where required by law.
5. Wildlife Encounters and Photography
Our trips take place in natural environments where wildlife behaviour, weather and ocean conditions cannot be controlled.
We cannot guarantee sightings or specific photographic opportunities. This includes, without limitation, particular species, bait balls, predator hunts, close encounters, underwater interactions, animal behaviour, visibility, lighting conditions or photographs of participants with wildlife.
Any wildlife descriptions, photographs, videos, past sightings or examples published on our website or social media are illustrative and do not guarantee that the same experience will occur during your trip.
Our team will make reasonable efforts to locate wildlife and deliver the experience described, while prioritising safety, animal welfare, applicable regulations and responsible wildlife observation.
We do not promise a particular photograph, image quality, number of sightings or minimum amount of time spent with any species. Participants acknowledge that wildlife encounters depend on factors beyond our control, including animal movements, seasonality, ocean conditions and the behaviour of other vessels or people.
We reserve the right to change the approach, distance, duration or method of an encounter whenever necessary to protect wildlife, participants or the team, or to comply with regulations.
6. Ocean Conditions, Safety and Changes to the Itinerary
Marine activities involve inherent risks, including changing weather, waves, currents, cold water, reduced visibility, slippery surfaces, vessel movement, collisions, equipment failure, fatigue, separation from the group, wildlife behaviour and delays in obtaining emergency assistance.
Participants acknowledge that these risks cannot be completely eliminated, even when reasonable precautions are taken.
All itineraries and schedules are subject to change depending on weather, swell, currents, visibility, wildlife activity, local regulations, permits, vessel availability, operational limitations and other circumstances affecting the safe delivery of the trip.
We may modify, postpone, substitute or cancel an activity where reasonably necessary. We may also change routes, departure times, locations, water-entry opportunities or the duration of an activity.
Our team has the authority to stop or restrict an activity if it considers that conditions are unsafe, wildlife welfare may be compromised, regulations require it or a participant is not following safety instructions.
A change to an individual activity does not automatically mean that the entire trip has been cancelled or that a refund is due. Any refund, alternative service or other remedy will be determined under the applicable booking terms and mandatory law, taking into account the circumstances and services actually delivered.
We will communicate material changes as soon as reasonably practicable.
7. Participant Responsibilities and Eligibility
By booking a trip, you confirm that you will:
Provide truthful and complete information relevant to your participation.
Meet the physical, swimming, water-confidence and other requirements communicated for the particular activity.
Inform us in advance of any relevant medical condition, injury, limitation, medication or other circumstance that could affect your safety or ability to participate.
Follow all instructions given by the skipper, guides and expedition team.
Wear and use the required safety equipment correctly.
Respect wildlife, other participants, local communities, the environment and applicable laws.
Avoid entering the water or approaching wildlife without explicit permission from the responsible team member.
Refrain from behaviour that endangers yourself, other participants, crew members or animals, including participation while impaired by alcohol or drugs.
We may ask for additional information or medical clearance where reasonably necessary for a particular activity.
We may refuse participation, remove a participant from an activity or terminate their participation if their condition, behaviour or failure to follow instructions creates a safety risk or materially interferes with the trip.
Where a participant is excluded because of their own conduct, failure to meet disclosed requirements or refusal to follow safety instructions, they will not automatically be entitled to a refund. Any entitlement will be assessed under the relevant booking terms and applicable law.
Participants are responsible for ensuring that they have suitable travel documents, any required permits or personal equipment, and the insurance coverage recommended or required for the trip.
8. Participant Cancellations, Deposits and Refunds
The cancellation policy displayed on the relevant trip page or supplied with the booking confirmation applies to that booking.
Unless a different policy is expressly stated, the following principles apply:
Deposits: Deposits are subject to the cancellation conditions disclosed for the particular trip and may be non-refundable to cover commitments and costs associated with reserving a place.
Cancellation by the participant: Requests to cancel must be sent to us in writing by email. The date we receive the request will be used to assess the applicable cancellation terms.
Late cancellations: Cancellations close to departure may result in the loss of some or all amounts paid, as specified in the applicable policy and subject to mandatory law.
No-shows and early departures: Failure to arrive on time, missing an activity, leaving a trip early or choosing not to participate in part of the itinerary does not automatically entitle the participant to a refund.
Replacement participants: We may permit a participant to transfer their place to a suitable replacement, subject to our written approval, applicable deadlines and any reasonable additional costs. A transfer is not guaranteed.
Travel expenses: We are not responsible for personal travel expenses such as flights, visas or independent accommodation that a participant incurs in connection with a booking, except where applicable law requires otherwise.
If a trip-specific cancellation policy has not been provided, please contact us before making payment so that the applicable conditions can be confirmed in writing.
Nothing in this section removes any refund or other rights that cannot legally be excluded.
9. Cancellation or Changes by Nomad of the Blue
We may need to cancel, postpone or substantially modify a trip because of unsafe conditions, insufficient operational availability, regulatory restrictions, permit issues, supplier failure, force majeure or other circumstances that prevent us from delivering the agreed service.
If we cancel a trip before it begins, we will inform affected participants and explain the available options under the applicable booking terms and law. Depending on the circumstances, these may include an alternative date, an alternative service or a refund of amounts paid for services not provided.
Where a trip is partially completed, any refund or other remedy will be assessed in accordance with the booking terms, the services delivered, recoverable supplier costs and applicable law.
We do not guarantee that an alternative date, equivalent wildlife encounter or replacement itinerary will be available.
We will not be responsible for costs incurred independently by participants, such as flights or accommodation, except where responsibility is imposed by applicable law or expressly accepted by us in writing.
10. Force Majeure and Circumstances Beyond Our Control
A force majeure event means an exceptional event beyond our reasonable control that prevents or materially affects the delivery of a service. Examples may include hurricanes, extreme weather, natural disasters, war, civil unrest, epidemics, government restrictions, unexpected closure of access areas, emergency regulations or serious disruptions to transport and essential services.
If such an event occurs, we may need to suspend, change, postpone or cancel affected activities.
We will take reasonable steps to communicate with participants and explore practical alternatives. Refunds, credits and other remedies will be handled in accordance with the applicable booking terms and mandatory law.
This section does not automatically exclude liability for circumstances for which we remain legally responsible.
11. Assumption of Risk and Limitation of Liability
Participation in boat-based wildlife tours, snorkelling, swimming and other marine activities involves inherent risks. These may include personal injury, illness, property loss, equipment damage, drowning and, in exceptional circumstances, death.
By participating, you acknowledge the nature of these activities and agree to take reasonable care for your own safety, follow instructions and comply with the safety procedures communicated by our team.
To the maximum extent permitted by applicable law, Nomad of the Blue will not be liable for loss or damage arising from circumstances outside our reasonable control, or from a participant's own negligence, failure to follow instructions, breach of these terms or failure to disclose relevant information.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited. Nothing in these terms removes any mandatory rights available to consumers.
Where legally permitted, we will not be responsible for indirect or consequential losses that are not reasonably foreseeable, including losses arising from missed flights, independent travel arrangements, lost opportunities or failure to obtain desired photographs.
Nothing in this section is intended to waive liability that cannot legally be waived or to replace any insurance or safety obligations applicable to our operations.
12. Travel Insurance and Medical Expenses
Participants are strongly advised to obtain comprehensive travel insurance appropriate to the activities they will undertake.
For multi-day expeditions, insurance should cover, where available and relevant, medical treatment, emergency evacuation, repatriation, trip cancellation and interruption, personal belongings and marine activities included in the itinerary.
Participants should check that their policy expressly covers the activities involved, including snorkelling, swimming in open water and boat-based wildlife activities, as applicable.
We are not an insurance provider and do not guarantee that a participant's policy will cover any particular incident.
Unless expressly included in the trip price or required by law, participants are responsible for their own medical expenses, insurance premiums and costs arising from personal travel disruption.
13. Equipment, Personal Belongings and Damage
Participants are responsible for their personal belongings and photographic equipment throughout the trip.
Marine environments present particular risks to cameras, lenses, housings, electronics and other valuable equipment. Participants should ensure that their equipment is suitable for the conditions and adequately insured.
We are not responsible for the loss or damage of personal belongings unless it results from circumstances for which we are legally responsible.
Any equipment supplied or rented by us must be used responsibly and returned in the condition in which it was provided, allowing for normal wear and tear.
Participants may be charged for loss or damage to equipment caused by their negligence, misuse or breach of instructions, to the extent permitted by law.
14. Third-Party Suppliers
Some components of our trips may be provided by independent suppliers, including accommodation providers, transport operators, boat operators, restaurants and local activity providers.
Where a service is provided by a third party, its own terms and operational requirements may apply.
We will take reasonable care when selecting and coordinating suppliers. However, we cannot guarantee the performance of independent suppliers or accept responsibility for their acts or omissions where we are not legally responsible for them.
Nothing in this section excludes any obligations we have as the organiser or seller of a package or other regulated tourism service under applicable law.
15. Photography, Video and Participant Images
Our team may take photographs or videos during tours and expeditions for documentation, expedition memories and, where agreed, promotional purposes.
We will seek appropriate consent before using identifiable participant images for marketing, advertising, social media or other public promotional purposes, in accordance with applicable privacy and image-rights laws.
Participation in a tour does not automatically constitute consent to the commercial use of a participant's image.
Where a participant does not wish to be photographed or featured in promotional content, they should inform us before the activity. We will make reasonable efforts to respect that preference without compromising safety or the normal operation of the trip.
Participants remain responsible for respecting the privacy and image rights of other guests. They must not publish identifiable images of other participants for commercial purposes without the necessary permission.
Any separate image release or consent form will apply according to its stated scope.
16. Intellectual Property and Website Content
Unless otherwise stated, the text, photographs, videos, graphics, logos, designs and other original content published on the Nomad of the Blue website and official channels belong to us or are used with permission.
You may view and share links to our public content for personal, non-commercial purposes, provided that you do not misrepresent its source.
You must not reproduce, sell, modify, distribute or use our content for commercial purposes without prior written permission from the relevant rights holder.
All rights not expressly granted are reserved.
17. Website Use and External Links
We make reasonable efforts to keep the website accurate and available. However, we do not guarantee that it will always be uninterrupted, error-free or free from technical issues.
Trip descriptions, photographs, wildlife sightings and sample itineraries are provided to help participants understand the experience. They do not override the specific inclusions, exclusions and conditions confirmed for an individual booking.
Our website may contain links to third-party websites or services. We do not control all third-party content, availability or privacy practices, and users should review the relevant terms before using those services.
18. Privacy and Personal Information
We collect and use personal information to respond to enquiries, assess applications, manage bookings, communicate with participants, organise trips and meet legal obligations.
Personal information will be handled in accordance with our Privacy Policy and applicable data protection laws.
We may share necessary information with relevant service providers where reasonably required to organise a booking, deliver a service, respond to an emergency or comply with legal obligations.
Please consult our Privacy Policy for further information about the information we collect, how it is used, retention periods and your rights.
19. Complaints and Customer Support
If you have a concern about a booking or service, please contact us at [Insert contact email] with your booking details and a description of the issue.
We will review the matter and endeavour to respond within a reasonable time.
Where a complaint concerns a third-party supplier, we may need to contact that supplier to investigate the circumstances.
This process does not prevent you from exercising any rights or pursuing any remedies available under applicable law.
20. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our services, operations or legal obligations.
The latest version will be published on our website with its updated date.
Changes will not retrospectively remove rights already acquired under a confirmed booking. The terms applicable to an existing booking will be determined by the agreement, any applicable trip-specific conditions and mandatory law.
21. Governing Law and Disputes
These Terms & Conditions are subject to the laws applicable to the relevant booking and service, including any mandatory consumer protection rules that apply.
Where a service is organised or supplied in Mexico, relevant Mexican laws and regulations may apply. The applicable forum and dispute-resolution process will be determined in accordance with those laws.
Nothing in this section prevents a consumer from exercising mandatory rights to bring a claim before a competent authority or court.
22. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be applied to the maximum extent legally permitted, and the remaining provisions will continue in effect where possible.
